Benefits Of A Trademark Registration

Build a strong brand that reflects your business identity and protect it the proper way. For many businesses, the most valuable asset is its good name. We can help you secure a word, logo or design that will be strongly identified with your product, service or business activity. We conduct clearance searches to ensure your trademark is protectable and does not conflict with existing marks. We register marks in the U.S. Patent and Trademark Office, state offices, as well as international trademark offices. We can monitor a competitor’s improper use of your mark and take appropriate action when needed.

Curious about the trademark process and want to know how to get a trademark? Read these simple steps.

Step 1: Do A Search

Once you have a name or logo picked out, you want to make sure that you will not get into trouble down the road by using someone else’s name. So do your search, search on the USPTO website, google, facebook, amazon or anywhere else you can think of. Don’t just search for the exact same wording or design, look for variations of those. An attorney can also help you with a professional search.

Step 2: If Your Mark Is Unique Enough – File For Your Trademark

You can do this all through the USPTO website. When filing, you will be asked about the:

  • Owner of the mark
  • About the trademark itself – (wording, logo)
  • If logo- you need to describe exactly what it looks like, colors etc.
  • Specimen

    • Something that shows the USPTO that you’re using this in commerce
  • Classes of goods or services:

    • You can file in 1 or multiple classes
    • When determining which classes – think about the nature of goods and services your business offers.

Step 3: Office Action

  • Non-substantive
  • Substantive

    • More difficult – USPTO found a reason to reject your case
      • 6 months to respond
      • contact a lawyer
      • response can be difficult and takes legal research to properly respond.
You then wait – this wait period is a lot shorter than the one for patents and you typically get an office action ( or communication)

Step 4: Published The Trademark For Opposition

Gives everyone an opportunity to oppose your trademark

Step 5: You Get Your Registered Mark

Make sure to file a statement of use between your 5th and 6th year and every 10 years after that if you continue having a prosperous business.

What Others Are Saying

Brian Derby

I hold Karima Gulick in high regard, as one of the brightest young up-and-coming attorneys in Southern California. I am fortunate to have had the opportunity to work with Karima over the course of the past several years and look forward to doing so again in the future.

I have a startup where we have exactly zero experience with IP and how to navigate this space, but we have a product we need to protect. We reached out to Karima who was able to help us understand exactly what had already been done, what needed to be done, the best way to do it and how. She even followed up to make sure we were on schedule and helped with all of our questions and concerns. It was a very confusing situation and she was able to make it all seem crystal clear. We will use Karima for all of our IP and trademark needs in the future!

Look no further for your trademark or patent concerns, services, or needs. I highly recommend Karima at Innovent Law. She has impeccable service. Her work is meticulous. Karima helped guide me through the trademark process with clarity and ease. She made the experience easy to understand. She sent me a questionnaire by email, the necessary forms/paperwork to fill out, once it was up to standard she collected payment and the application was sent. Her experience in this field is outstanding.
I write this review with gratitude.
