Curious about the patent process and want to know how to get a trademark? Read these simple steps.

Step 1: Do A Search

Once you have a name or logo picked out, you want to make sure that you will not get into trouble down the road by using someone else’s name. So do your search, search on the USPTO website, google, facebook, amazon or anywhere else you can think of. Don’t just search for the exact same wording or design, look for variations of those. An attorney can also help you with a professional search.

Step 2: If Your Mark Is Unique Enough – File For Your Trademark

You can do this all through the USPTO website. When filing, you will be asked about the:

  • Owner of the mark
  • About the trademark itself – (wording, logo)
  • If logo- you need to describe exactly what it looks like, colors etc.
  • Specimen

    • Something that shows the USPTO that you’re using this in commerce
  • Classes of goods or services:

    • You can file in 1 or multiple classes
    • When determining which classes – think about the nature of goods and services your business offers.

Step 3: Office Action

  • Non-substantive
  • Substantive

    • More difficult – USPTO found a reason to reject your case
      • 6 months to respond
      • contact a lawyer
      • response can be difficult and takes legal research to properly respond.
You then wait – this wait period is a lot shorter than the one for patents and you typically get an office action ( or communication)

Step 4: Published The Trademark For Opposition

Gives everyone an opportunity to oppose your trademark

Step 5: You Get Your Registered Mark

Make sure to file a statement of use between your 5th and 6th year and every 10 years after that if you continue having a prosperous business.
